An Act Respecting the Degree Granting Act
His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Degree Granting Act
1( 1) Section 1 of the Degree Granting Act, chapter 140 of the Revised Statutes, 2011, is amended in paragraph (d) of the definition “educational institution” by striking out “or conferring”.
1( 2) Section 2 of the Act is amended
(a)  by repealing subsection (1) and substituting the following:
2( 1) Subject to subsection (1.1) and section 3.1, an educational institution located in the Province may directly or indirectly
(a)  grant a degree,
(b)  provide a program of post-secondary study leading to a degree,
(c)  advertise a program of post-secondary study leading to a degree, or
(d)  sell, offer for sale or provide by agreement for a fee, reward or other remuneration, a diploma, certificate, document or other material that is, or that indicates or implies the granting of, a degree.
(b)  by adding after subsection (1) the following:
2( 1.1) An educational institution may take any measure referred to in subsection (1) if the educational institution
(a)  makes an application to the Minister,
(b)  meets the requirements set out in the regulations, and
(c)  is designated by the Lieutenant-Governor in Council as a degree-granting institution or authorized by an Act of the Legislature to grant degrees.
(c)  by repealing subsection (3).
1( 3) Section 3 of the Act is amended
(a)  by repealing subsection (1) and substituting the following:
3( 1) The Lieutenant-Governor in Council may designate an educational institution as a degree-granting institution for the purposes of this Act.
(b)  by adding after subsection (1) the following:
3( 1.1) The designation shall specify the programs of post-secondary study leading to a degree the institution may provide.
3( 1.2) The designation may specify any terms and conditions that the Lieutenant-Governor in Council considers necessary to give effect to this Act.
1( 4) The Act is amended by adding after section 3 the following:
Programs of post-secondary study
3.1( 1) An educational institution designated as a degree-granting institution under subsection 3(1) may make an application to the Minister, and if the educational institution meets the requirements set out in the regulations, the Minister may approve the provision of additional programs of post-secondary study leading to a degree for a term determined by the Minister, subject to the terms and conditions determined by the Minister.
3.1( 2) The Minister may suspend or revoke an approval under subsection (1) if the educational institution fails to meet the requirements set out in the regulations or to comply with the terms and conditions determined by the Minister.
3.1( 3) The Minister may permit a degree-granting institution to advertise additional programs of post-secondary study leading to a degree before an approval is obtained under subsection (1).
1( 5) Section 11 of the Act is amended
(a)  in paragraph (a) by striking out “subsection 2(1)” and substituting “paragraph 2(1.1)(a)”;
(b)  in paragraph (b) by striking out “subsection 2(1)” and substituting “paragraph 2(1.1)(b)”;
(c)  in paragraph (c) by striking out “subsection 2(1)” and substituting “subsection 2(1.1)”.
Regulation under the Degree Granting Act
2( 1) The heading “Critères à remplir par une institution d’enseignement” preceding section 3 of the French version of New Brunswick Regulation 2001-9 under the Degree Granting Act is amended by striking out “Critères à remplir par une institution” and substituting “Exigences auxquelles doit satisfaire l’établissement”.
2( 2) Section 3 of the Regulation is amended
(a)  in subsection (1)
( i) by repealing the portion preceding paragraph (a) and substituting the following:
3( 1) If an educational institution applies to the Minister under subsection 2(1.1) of the Act, the educational institution shall meet the following requirements:
( ii) in paragraph a) of the French version in the portion preceding subparagraph (i) by striking out “l’institution” and substituting “l’établissement”;
( iii) in paragraph b) of the French version in the portion preceding subparagraph (i) by striking out “l’institution” and substituting “l’établissement”;
( iv) in paragraph c) of the French version by striking out “lorsqu’elle fournit des programmes liés à une certaine industrie, l’institution” and substituting “lorsqu’il offre des programmes liés à une certaine industrie, l’établissement”;
( v) in paragraph d) of the French version by striking out “l’institution” wherever it appears and substituting “l’établissement”;
( vi) in paragraph e) of the French version by striking out “l’institution” and substituting “l’établissement”;
( vii) in paragraph f) of the French version by striking out “l’institution” and substituting “l’établissement”;
(b)  in subsection (2) of the French version by striking out “Une institution d’enseignement visée” and “critères prévus” and substituting “L’établissement d’enseignement visé” and “exigences prévues”, respectively;
(c)  by adding after subsection (2) the following:
3( 3) If an educational institution applies to the Minister under subsection 3.1(1) of the Act, the educational institution shall meet the requirements under subsection (1) with respect to the additional programs of post-secondary study.
2( 3) The heading “Demande au Ministre” preceding section 4 of the French version of the Regulation is amended by striking out “Ministre” and substituting “ministre”.
2( 4) Section 4 of the Regulation is amended
(a)  in subsection (1) by striking out “subsection 2(1)” and substituting “paragraph 2(1.1)(a)”;
(b)  in subsection (2) by striking out “Where” and substituting “With respect to an application under paragraph 2(1.1)(a) of the Act, if”;
(c)  by adding after subsection (2) the following:
4( 3) An application under subsection 3.1(1) of the Act shall be made to the Minister on a form provided by the Minister.
2( 5) Section 6 of the French version of the Regulation is amended
(a)  in subsection (1) by striking out “Une institution d’enseignement qui a été désignée” and “critères indiqués” and substituting “L’établissement d’enseignement qui a été désigné” and “exigences fixées”, respectively;
(b)  in subsection (2) by striking out “Une institution d’enseignement qui est autorisée” and substituting “L’établissement d’enseignement qui est autorisé”;
(c)  in subsection (3) by striking out “Une institution” and “Ministre” and substituting “L’établissement” and “ministre”, respectively.
2( 6) Section 7 of the French version of the Regulation is amended
(a)  in subsection (1) by striking out “Une institution d’enseignement doit faire au Ministre” and substituting “L’établissement d’enseignement est tenu de faire au ministre”;
(b)  in subsection (2) by striking out “l’institution” and “critères indiqués” and substituting “l’établissement” and “exigences fixées”, respectively;
(c)  by repealing subsection (3) and substituting the following:
7( 3) Lorsqu’il est convaincu que l’établissement d’enseignement satisfait aux exigences fixées à l’article 3, le ministre peut recommander le renouvellement de la désignation au lieutenant-gouverneur en conseil, qui peut choisir de la renouveler.
2( 7) Section 8 of the French version of the Regulation is amended
(a)  by repealing the portion preceding paragraph a) and substituting the following:
8 Le lieutenant-gouverneur en conseil peut, sur la recommandation du ministre, révoquer la désignation d’un établissement d’enseignement qui, selon le ministre,
(b)  in paragraph a) by striking out “remplit plus ou ne veut plus remplir les critères de” and substituting “satisfait plus ni ne veut plus satisfaire aux exigences relatives à”.
2( 8) Section 9 of the French version of the Regulation is amended
(a)  in subsection (1) by striking out “Toute institution” and “Ministre” and substituting “Tout établissement” and “ministre”, respectively;
(b)  in subsection (3) by striking out “l’institution” and “critères indiqués” and substituting “l’établissement” and “exigences fixées”, respectively;
(c)  by repealing subsection (4) and substituting the following:
9( 4) Lorsqu’il est convaincu que l’établissement d’enseignement satisfait aux exigences fixées à l’article 3, le ministre peut recommander le rétablissement de sa désignation au lieutenant-gouverneur en conseil, qui peut choisir de la rétablir.
2( 9) Section 10 of the French version of the Regulation is amended by striking out “Ministre” and substituting “ministre”.
